DISABLED VETERANS - EXPERIENCED SOCIAL SECURITY HELP HERE

The initial decision on a disability claim is are made by the state of Alabama, not by Social Security.  A state agency known as the Disability Determination Service, or DDS for short, decides if a claimant technically meets the medical requirement for disability.  Forsythe explains, "The DDS denies about 7 out of 10 disability claims, often through error.  It is up to the claimant to challenge the denial with an appeal and get matters corrected."  There is a 60-day deadline to file this appeal.

"Nobody expects Social Security to get every decision right," Forsythe adds.  "Just the opposite.  We expect them to get many of them wrong.  That's where advocates or attorneys come in and that's where denied claimants need help to fix things."

Social Security provides that a claimant may appoint legal counsel without paying any fee (or expenses) until the case has been resolved in the claimant's favor.  Because he or she doesn't have to put up any money, the claimant can hire the best legal representation and pay only if he wins and only after Social Security pay the benefit.

Here is an example:

John Claimant filed for disability and was denied.  He hired Mr. Advocate to help him with an appeal.  Mr. Advocate worked without pay for several months, even spending his own money to cover legal expenses. Finally, a judge found that Mr. Claimant was eligible for disability benefits and ordered Social Security to pay benefits back to the original onset date.  When Social Security paid Mr. Claimant, they withheld a percentage of the back pay and paid Mr. Advocate for his services.  Mr. Claimant received a large lump sum settlement (back pay) and a monthly check for as long as he continues to be disabled.  If Mr. Claimant had never been approved, all of Mr. Advocate's work would have been free.
