JODY'S STORY

Jody was discharged from military service after doctors determined he was not medically fit for service.  He had served with distinction for 18 years and had been deployed twice, both to Afghanistan and Iraq.

Jody's wife had gone back to school to pursue a degree in the healthcare field but was only working part time.  Jody came to the Forsythe Firm looking for a way to obtain financial assistance while the VA decided how much benefits he would get.  The financial need was becoming a burden and the family was quite concerned about making ends meet.

We immediately filed a Social Security disability claim.  Fortunately, the VA provided us with excellent medical documentation of Jody's back, shoulder and leg problems.  There had recently been some psychological issues developing and these strengthened the Social Security claim.

We were able to show that Jody was not able to persistently perform any job that was available in substantial numbers in the civilian economy.  We used the combined effect of his exertional impairments (such as a limited ability to stand, walk and lift) along with his psychological symptoms to prove a residual functional capacity less than that required for sedentary unskilled work.  Even though Jody was relatively young (below age 45), Social Security found that he was disabled and awarded him a fully favorable decision, which included past due pay while he had been waiting for a decision to process.

HOW TO GET SSDI PAYMENTS (Social Security Disability Benefits)

WHAT IS SSDI?   SSDI stands for Social Security Disability Insurance. Since 1956, the US government has required most workers to contribute to a mandatory disability insurance plan administered by the Social Security Administration.  Workers contribute approximately 7.5% of their income (listed as FICA tax on your pay stub) and employers match that amount.  The money goes into a trust account under each worker's Social Security number. USE BOTH PHYSICAL AND MENTAL RESTRICTIONS TO WIN DISABILITY

In Social Security disability cases, decision makers will often deny a claim on the supposition that the claimant can still perform unskilled, sedentary work.  Examples of such unskilled sedentary work might be a surveillance system monitor, or a document preparer. All work has mental as well as physical demands.  The mental demands of unskilled sedentary work are defined by SSR 96-9p and SSR 85-15.  Those demands include the abilities (on a sustained basis) to understand, carry out, and remember simple instructions; to respond appropriately to supervision, coworkers, and usual work situations; and to deal with changes in a routine work setting. The loss of any of the above abilities will substantially erode the occupational base for sedentary, unskilled work and will, therefore, justify a finding of disability.
